GENERAL TERMS AND CONDITIONS

1. Scope of Application

These terms and conditions apply to all orders placed via our online store. Our online store is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with a legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2. Contractual Partner and Conclusion of Contract

The purchase contract is concluded with LISCA d.o.o., Prešernova 4, 8290 Sevnica, Slovenia. By placing products in our online store, we submit a binding offer to conclude a contract for those items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided in the order process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after sending the order, you will receive an order confirmation by e-mail.

3. Contract Language and Storage

The language available for the conclusion of the contract is English. We save the text of the contract and send you the order data and our General Terms and Conditions by e-mail.

4. Terms of Delivery

Shipping costs may apply in addition to the indicated product prices. You can find more details about shipping costs in the offers. Goods are generally delivered via the dispatch route to the delivery address specified by the customer unless otherwise agreed. For the transaction, the delivery address specified by the customer in the ordering process applies. Unfortunately, it is not possible to collect the goods yourself. We do not deliver to packing stations.

5. Payment
  • PayPal: During the ordering process, you will be redirected to the PayPal website. To pay via PayPal, you must be registered there or register first, verify your access data, and confirm the payment instruction to us. After placing the order in the store, we request PayPal to initiate the payment transaction. The transaction is carried out automatically by PayPal after the goods have been dispatched. Further information will be provided during the ordering process.
  • Credit Card: When the order is placed, the order amount is reserved on the customer's credit card (authorization). The card is charged when we receive confirmation that the products are available in stock and the order processing begins. Payment by credit card is made via the secure internet payment system WSPay. Payments are made in real time using credit and debit cards and other payment methods. WSPay offers the customer and merchant secure entry and transmission of card data, which is confirmed by WSPay's PCI DDS certificate. WSPay uses 256-bit encrypted SSL certification and the TLS 1.2 cryptographic protocol as the highest level of data protection when writing and transferring data.
6. Retention of Title

The goods remain our property until full payment has been made.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, particularly your warranty rights. However, reporting helps us assert our claims against the carrier or transport insurance company.

8. Warranty and Guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies. The following applies to used goods: if the defect occurs after one year from delivery, claims for defects are excluded. Defects that occur within one year of delivery can be claimed within the statutory limitation period of two years from delivery. These restrictions do not apply to claims based on damage caused by us, our legal representatives, or vicarious agents:

  • In the event of injury to life, limb, or health
  • In the event of intentional or grossly negligent breach of duty or fraudulent intent
  • In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract (cardinal obligations)
  • Within the scope of a guarantee promise, if agreed
  • Insofar as the Product Liability Act is applicable.

9. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives, or vicarious agents:

  • In the event of injury to life, limb, or health
  • In the event of intentional or grossly negligent breach of duty
  • In the case of warranty promises, if agreed
  • Insofar as the Product Liability Act is applicable.

In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited to the foreseeable damage at the time of the contract's conclusion. Otherwise, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find HERE. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
